1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the AspectShift-HtoV website, purchases made through official sales channels, license activation and update services, official downloads, and official compiled builds of the AspectShift-HtoV software provided by Software From Vish.

By accessing the website, purchasing a license, downloading an official build, activating a license key, or using AspectShift-HtoV, you agree to these Terms. If you do not agree, do not use the website, purchase a license, download an official build, activate a license key, or use the official compiled software package.

AspectShift-HtoV is a desktop video repurposing and batch conversion application designed to help users convert, transform, subtitle, and process videos for platforms such as Shorts, Reels, Reddit, Instagram, and custom aspect ratios.

2. Website Use

You may use this website to learn about AspectShift-HtoV, access product information, view documentation or updates, contact support, and reach official purchase, download, or repository links.

You are responsible for using the website lawfully and for ensuring that any information you submit through contact, support, purchase, or license-related workflows is accurate and not misleading.

You may not use the website to:

Attempt to interfere with, disrupt, overload, scan, or compromise the website, purchase flow, license services, update services, or related infrastructure.
Circumvent, bypass, disable, tamper with, or interfere with license validation, activation, update checks, access-control systems, or security features.
Misrepresent unofficial builds, downloads, websites, support channels, or services as official AspectShift-HtoV materials.
Use the AspectShift-HtoV name, trademark, branding, or product identity in a way that suggests endorsement, sponsorship, or official distribution without permission.
Use the website or related services for unlawful purposes or to violate the rights of others.

3. Open-Source License Notice

AspectShift-HtoV is made available as open-source software under the GNU General Public License version 3.0 or later (“GPL-3.0-or-later”).

Nothing in these Terms is intended to limit, remove, or override any rights granted to you under the GPL-3.0-or-later license for the GPL-licensed source code and software rights.

Where these Terms conflict with the GPL-3.0-or-later license, the GPL-3.0-or-later license controls with respect to the GPL-licensed source code and software rights.

These Terms primarily govern the website, official compiled builds, official installers, license keys, activation services, update access, support access, trademarks, branding, paid distribution, and related services provided by Software From Vish.

4. License Grant for Official Builds

Subject to your compliance with these Terms and the applicable open-source license terms, Software From Vish grants you a limited, non-exclusive, non-transferable license to install and use the official compiled version of AspectShift-HtoV.

A paid license may be activated on up to two (2) personal or business computers owned or controlled by the license holder.

This license permits use of AspectShift-HtoV for personal and commercial video processing purposes, including monetized content creation, client work, social media publishing, and business workflows.

5. Community and Pro Editions

AspectShift-HtoV may operate in different license states.

Community Edition

The Community Edition is available when no paid license is registered. It provides access to core software features but may not receive official update access or licensed update services.

Pro Edition

The Pro Edition is available when a valid paid license is registered and activated. Pro users receive access to official updates for as long as the project is supported by Vishwas Sharma / Software From Vish.

Both Community and Pro editions may provide access to core application features. Paid licensing is primarily used for official update access, license validation, and continued project support.

Future optional subscription services may be introduced. Any such subscription will be optional unless separately stated at the point of purchase and will not automatically remove access to core features already provided under the applicable license terms.

6. Purchases, Downloads, and Third-Party Payment Services

Official purchases and license delivery are handled through Gumroad. Gumroad may process payment details, receipts, refunds, license key delivery, and related transaction information under its own terms, privacy, and security policies.

After purchase, Gumroad provides a license key. You are responsible for keeping your license key secure. License keys are personal to the purchaser and may not be shared publicly or privately with other users.

Official downloads, license keys, update credentials, and branded release packages provided by Software From Vish may not be resold, misrepresented, or redistributed as official commercial products without permission.

Future sales through the official website purchase flow may be subject to the purchase, payment, and refund terms displayed at the point of sale.

7. License Key Use and Activation

A paid license key may be used on up to two (2) computers owned or controlled by the license holder.

AspectShift-HtoV may connect to the internet for license activation, license refresh, license validation, update checks, and related validation services.

License keys may be implemented using token-based validation systems, including JWT-based license tokens. These tokens may have limited validity periods and may require periodic refresh.

Users should connect the application to the internet at least once per month to refresh license status. If license refresh does not occur, the application may enter a grace period. If the license remains unrefreshed beyond the grace period, update access and Pro license status may expire or become inactive.

License duration, refresh behavior, grace periods, token lifetime, and validation rules may be changed by Software From Vish as needed for security, abuse prevention, or service maintenance.

If a license expires, fails validation, is revoked, or is associated with a refunded purchase, the user may lose access to Pro status and official update access.

8. Updates

Software From Vish may provide updates, patches, improvements, bug fixes, security fixes, or feature changes for AspectShift-HtoV.

Updates may be provided through automatic update prompts, manual update checks, direct downloads, or other official distribution methods.

The application may periodically and automatically check for available updates approximately once every seven (7) days. Users may also manually check for updates through the application’s update functionality. Automatic update checks are intended solely to determine update availability and do not automatically install updates without user approval unless explicitly stated by a future version of the software.

Paid Pro users are intended to receive free official updates for as long as Vishwas Sharma / Software From Vish continues to support AspectShift-HtoV.

Software From Vish does not guarantee that updates will be provided forever, on a fixed schedule, or for every operating system version.

Updates may add, modify, or remove features, improve performance, change user interface behavior, update dependencies, or alter compatibility.

9. Support

Support may be provided through official contact channels, including:

Support may include help with activation, installation, update issues, license refresh issues, and general usage questions.

Support is provided on a best-effort basis and is not guaranteed to be available at all times. Response times are not guaranteed unless separately stated in writing.

10. Refunds

Purchases made through Gumroad are eligible for refund consideration within seven (7) days of purchase, subject to the refund terms shown at the point of sale and the processing rules of the applicable sales platform.

Refund requests may be denied in cases of abuse, fraud, excessive use, license sharing, chargeback misuse, violation of these Terms, or other circumstances determined by Software From Vish.

If a refund is issued, the associated paid license key may be revoked, and the user may lose Pro status, official update access, and paid-license benefits.

11. User Responsibilities

You are responsible for ensuring that you have the necessary rights to process any videos, audio, subtitles, images, logos, or other materials used with the software.

You are responsible for maintaining backups of your original files, videos, audio, images, subtitles, presets, projects, and exported content.

You should not rely on AspectShift-HtoV as the only storage location for important media or production assets. Before processing important files, you should ensure that backup copies exist.

You are responsible for reviewing and verifying generated subtitles, captions, exports, and processed media before publication or commercial use.

12. Restrictions

Except where expressly permitted by the GPL-3.0-or-later license or applicable law, you may not:

Share, sell, rent, lease, sublicense, or transfer your paid license key.
Use one paid license key on more than two (2) computers.
Circumvent, bypass, disable, tamper with, or interfere with license validation, activation, update checks, access-control systems, or related services.
Misrepresent unofficial builds as official builds from Software From Vish.
Use the AspectShift-HtoV name, trademark, branding, or product identity in a way that suggests endorsement, sponsorship, or official distribution without permission.
Sell unofficial compiled copies as official AspectShift-HtoV products.
Remove or obscure copyright, license, attribution, or third-party notices from official builds.
Use the software, website, purchase flow, license services, update services, or support channels for unlawful purposes or to violate the rights of others.

Because AspectShift-HtoV is open-source software under GPL-3.0-or-later, these Terms do not prohibit users from exercising rights granted by the GPL, including viewing, studying, modifying, or redistributing GPL-licensed source code in accordance with the GPL.

However, license keys, paid update access, official branding, official support channels, trademarks, and commercial services are not transferred by redistribution of the source code or unofficial builds.

13. Redistribution of Source Code and Official Builds

The AspectShift-HtoV source code may be used, copied, modified, and redistributed only in accordance with the GPL-3.0-or-later license.

If you distribute modified versions or unofficial builds, you must comply with the GPL-3.0-or-later license and must not imply that your version is an official release by Software From Vish unless written permission is granted.

Attribution to the original project and preservation of applicable copyright and license notices are required where applicable.

Official compiled installers, official paid builds, license keys, update credentials, and branded release packages provided by Software From Vish may not be resold, misrepresented, or redistributed as official commercial products without permission.

14. Ownership and Intellectual Property

AspectShift-HtoV is licensed, not sold.

All rights, title, and interest in the AspectShift-HtoV name, official branding, official compiled builds, installer packaging, website materials, product identity, logos, trademarks, documentation, and related commercial materials remain owned by Vishwas Sharma and/or Software From Vish, except for third-party components and open-source materials owned by their respective authors.

AspectShift-HtoV is a trademark of Software From Vish.

Purchasing a license does not transfer ownership of the software, trademarks, brand identity, official distribution channels, update infrastructure, support systems, or commercial rights.

15. Privacy and Data Collection

Your use of the website and software is also described in the Privacy Policy.

AspectShift-HtoV does not upload user videos, user media files, exported files, subtitles, projects, or local processing data to Software From Vish servers.

The application may connect to online services for:

License activation.
License refresh.
License validation.
Manual update checks initiated by the user.
Automatic periodic update checks performed approximately once every seven (7) days.
Update downloads or update availability information.

Software From Vish does not intentionally collect usage analytics, crash reports, video files, project files, or personal media through the application.

This website may collect basic usage data through hosting logs, such as page requests, browser information, and approximate region. Purchases and license delivery are handled by Gumroad, which may process payment details, receipts, refunds, and license key delivery under its own policies.

Server logs may be generated when activation, refresh, update checks, or related online requests occur. Such logs may include technical information normally transmitted during internet requests, such as IP address, timestamp, request metadata, license validation request data, and server response information.

Users are responsible for the content they process locally using AspectShift-HtoV.

16. Third-Party Components and Services

AspectShift-HtoV includes or may interact with third-party software components.

Known third-party components include, but may not be limited to:

FFmpeg.
FFprobe.
Whisper-related binaries.
Whisper models.
Tauri and related dependencies.
Other open-source libraries used by the application.

FFmpeg and FFprobe may be bundled with the official application package and are used for video and media processing.

Whisper binaries and models may be optional downloadable components used for subtitle-related features. These components may be required for certain subtitle, transcription, or caption workflows.

Third-party components are licensed by their respective copyright holders and are subject to their own license terms. Third-party notices, acknowledgements, and license information may be provided in the application, documentation, repository, or accompanying notices.

The website and purchase flow may also rely on third-party service providers, including hosting, email, analytics if enabled, and Gumroad.

Software From Vish does not claim ownership of third-party components or third-party services.

17. AI and Media Processing Features

AspectShift-HtoV may include or support AI-assisted features, including transcription, subtitle generation, caption workflows, video enhancement, or other creator-focused automation features.

AI-related features may depend on optional third-party components, models, binaries, or future services.

AI-generated or automatically generated results may contain errors, inaccuracies, formatting issues, timing errors, transcription mistakes, or incomplete outputs. Users are responsible for reviewing and verifying generated subtitles, captions, exports, and processed media before publication or commercial use.

18. Local Processing and Cloud Services

AspectShift-HtoV currently performs video processing locally and does not upload user videos or media files to Software From Vish servers.

Cloud services are not currently available.

If cloud-based features are introduced in the future, additional terms, privacy disclosures, or service-specific policies may apply.

19. No Warranty

The website, official downloads, license services, update services, support channels, and AspectShift-HtoV software are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Software From Vish and Vishwas Sharma disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, uninterrupted operation, and error-free performance.

Software From Vish does not guarantee that:

The website, purchase flow, download links, license services, update services, or support channels will be uninterrupted or error-free.
The software will be free from bugs or errors.
Video processing will always complete successfully.
Outputs will always meet platform requirements.
Subtitles, captions, or AI-assisted results will always be accurate.
The software will be compatible with all files, codecs, devices, drivers, or operating system configurations.
Updates will always be available.
Third-party components or third-party services will always remain available or functional.

20. Limitation of Liability

To the maximum extent permitted by law, Software From Vish, Vishwas Sharma, contributors, licensors, and third-party component providers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to access to the website, purchases, downloads, installation, activation, update access, use, misuse, inability to use, or performance of AspectShift-HtoV.

This includes, but is not limited to:

Lost, corrupted, damaged, overwritten, or unusable videos.
Lost projects or lost output files.
Failed processing jobs.
Incorrect subtitles or captions.
Business interruption.
Lost revenue, lost profits, or lost opportunities.
Platform rejection of exported videos.
Hardware, software, driver, or operating system issues.
Problems caused by FFmpeg, FFprobe, Whisper, models, codecs, or other third-party components.
Problems caused by Gumroad, hosting, email, analytics, or other third-party service providers.
Any damages resulting from user error, unsupported files, misconfiguration, or incompatible environments.

AspectShift-HtoV uses FFmpeg and other open-source components for media processing. Users accept that media processing carries inherent risks and should keep backups of original files before processing.

Where liability cannot be fully excluded under applicable law, liability shall be limited to the lowest amount permitted by law.

21. Termination

These Terms and any paid license benefits may terminate automatically if you violate these Terms.

Grounds for termination or license revocation may include:

Sharing license keys.
Using a license key on more than two (2) computers.
Refunding the purchase after activation.
Attempting to bypass activation or license validation.
Misusing update services, license services, website services, or support channels.
Selling or misrepresenting unofficial copies as official builds.
Violating applicable law.
Violating these Terms.

Upon termination, Pro status, update access, support access, and license validation may be revoked.

Termination of paid license benefits does not remove any rights you may independently have under the GPL-3.0-or-later license for GPL-licensed source code.

22. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India, without regard to conflict-of-law principles.

Subject to applicable law, disputes arising out of or relating to these Terms, the website, official downloads, official installers, paid license keys, update access, or official services shall be subject to the jurisdiction of the courts located in Bhopal, Madhya Pradesh, India.

23. Changes to These Terms

Software From Vish may update these Terms from time to time.

Updated terms may apply to future website use, future versions, future downloads, future purchases, future activations, update services, optional subscription services, or newly introduced features.

Continued use of the website, official builds, license services, update services, or paid services after changes become effective may constitute acceptance of the updated Terms.
